Terms and Conditions
GENERAL PROVISIONS
1.1 These purchase and sale terms (hereinafter - the Terms) establish the mutual rights, obligations, and responsibilities between the person purchasing goods from the www.autokilimeliaionline.lt online store (hereinafter - the Buyer) and www.autokilimeliaionline.lt (hereinafter - the Seller) when the Buyer purchases goods from the online store. By purchasing goods from the online store, the Buyer agrees to the application of these Terms.
1.2 The Seller reserves the right to change, correct, or supplement the Terms at any time, in accordance with the requirements set by legal acts.
PERSONAL DATA PROTECTION
2.1 The Buyer can order goods from the online store by:
2.1.1. registering on the www.autokilimeliaionline.lt online store - by entering the requested data during registration.
2.2 When ordering goods as specified in clause 2.1.1 of the Terms, the Buyer must provide the necessary personal data in the appropriate fields provided by the Seller for the proper execution of the order: name, surname, delivery address, phone number, and email address.
2.3 By confirming these Terms, the Buyer agrees that the personal data provided in clause 2.2 may be processed for the purposes of selling goods and services in the online store, analyzing the Seller's activities, and may be collected, stored, and systematized.
2.4 By agreeing to the processing of the Buyer's personal data for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees to receive informational messages necessary for the execution of the order at the email address provided by the Buyer.
2.5 Any information related to personal data that is registered on "www.autokilimeliaionline.lt" is considered confidential and is not made public.
2.6 The personal data provided by the Buyer is processed in compliance with the requirements of the Law on Legal Protection of Personal Data of the Republic of Lithuania.
BUYER'S RIGHTS
3.1 The Buyer has the right to purchase goods from the online store in accordance with these Terms and the legal acts of the Republic of Lithuania.
3.2 The Buyer has the right to freely change, supplement, or delete their registration data at any time.
3.3 The Buyer has the right to request a replacement of the goods or a refund if the goods have expired or are of poor quality.
3.3.1 Goods of unsatisfactory quality are replaced or returned in accordance with the Retail Trade Rules approved by Resolution No. 697 of the Government of the Republic of Lithuania dated June 11, 2001, the Civil Code of the Republic of Lithuania, and other applicable legal acts of the Republic of Lithuania.
BUYER'S OBLIGATIONS
4.1. The Buyer must pay for the goods and their delivery and accept the ordered goods. The Buyer pays for the goods using their online bank or by making a payment from any other bank to the Seller's account.
4.2 By registering in the online store and ordering goods, the Buyer agrees to protect and not disclose their login information.
4.3 The Buyer is responsible for ensuring that the data provided in the registration form is accurate, correct, and complete. If the Buyer's registration information changes, they must update it immediately. The Intermediary will not be liable for any damage caused to the Buyer and/or third parties due to the Buyer providing incorrect and/or incomplete personal data or failing to change and supplement the data when it changes.
4.4 By using the online store, the Buyer agrees to these Terms of purchase and sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
SELLER'S RIGHTS
5.1 If the Buyer attempts to harm the operation, stable functioning, or security of the Seller's online store, the Seller may restrict, suspend, or terminate the Buyer's ability to use the online store without prior notice.
5.2 The Seller has the right to unilaterally change these Terms by publishing them on the online store's website. The changes take effect from the moment of publication for all transactions concluded after the publication.
5.3 The Seller has other rights provided for in the Terms and legal acts of the Republic of Lithuania.
SELLER'S OBLIGATIONS
6.1 The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store.
6.2 The Seller undertakes to respect the Buyer's right to privacy regarding the personal information provided in the online store's registration form.
6.3 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
6.4 If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, the Seller undertakes to offer an analogous or as similar as possible product. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to refund the money paid by the Buyer.
ORDERING GOODS, PRICES, PAYMENT PROCEDURES AND TERMS
7.1. The Buyer can make purchases from the online store 24 hours a day, 7 days a week.
7.2 The prices of goods in the www.autokilimeliaionline.lt online store and in the generated order are indicated in Euros.
7.3 The Buyer can pay for the goods in one of the following ways:
7.3.1 Payment using electronic banking - this is an advance payment using the Buyer's electronic banking system. To use this form of payment, the Buyer must have signed an electronic banking agreement with one of the following banks: "Swedbank", AB, "Nordea Bank Finland Plc" Lithuanian branch; AB SEB bank, AB DNB bank, or Danske Bank A/S Lithuanian branch. In this case, the responsibility for data security lies with the respective bank, as all monetary operations take place in the bank's electronic banking system.
7.3.2 Payment by bank transfer - this is an advance payment where the Buyer, after printing the order, transfers money to our bank account.
7.4 The Buyer undertakes to pay for the goods as soon as possible. The shipment of goods begins and the delivery time starts to be calculated only after receiving payment for the goods.
DELIVERY OF GOODS
8.1 The exact delivery cost depends on the weight of the ordered goods. Goods are delivered throughout Lithuania within 2-5 business days.
8.2 When ordering goods, the Buyer undertakes to provide the delivery location and contact phone number. The Buyer must provide an accurate address where the courier can deliver the goods and where the Buyer can be reached. If the goods are not delivered to the buyer due to the buyer's fault (incorrect contact details provided, the buyer is not reachable), the buyer undertakes to pay an additional fee, depending on the weight of the goods, for re-delivery.
8.3 The Buyer undertakes to receive the goods personally. In cases where the Buyer cannot receive the goods personally, and the goods are delivered to the specified address based on other data provided by the Buyer, the Buyer has no right to make claims against the Seller for delivering the goods to an inappropriate subject.
8.4 The Seller undertakes to deliver the goods to the Buyer within the terms specified in the product descriptions. At the same time, the Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such cases, the Seller undertakes to immediately contact the Buyer and coordinate the delivery issues.
8.5 In all cases, the Seller is released from liability for violation of goods delivery terms if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances dependent on the Buyer.
8.6 At the time of delivery, the Buyer must check the condition of the package, the quantity, quality, and assortment of the goods together with the courier. Once the Buyer signs the invoice (waybill) or other shipment transfer-acceptance document, it is considered that the shipment has been transferred in proper condition. If the Buyer notices that the delivered package is damaged (crumpled, wet, or otherwise externally damaged), the Buyer must not accept such a shipment and must note this on the invoice (waybill) or other shipment transfer-acceptance document and, in the presence of the courier, draw up a free-form shipment damage report. If the Buyer fails to perform these actions, the Seller is released from liability to the Buyer for damages to the goods that the Buyer did not note in the manner specified above.
8.7 If the Buyer or, as the case may be, the Buyer's representative accepts the shipment and signs the data collector provided by the transport company representative or the paper delivery confirmation without comments, it is considered that the goods were delivered in an undamaged package, and the quantity, quality, and assortment of the goods comply with the terms of the purchase and sale agreement.
8.8 Upon delivery and transfer of the goods to the address specified by the Buyer, it is considered that the goods have been transferred to the Buyer, regardless of whether the goods are actually received by the Buyer or any other person who accepted the goods at the specified address.
8.9 If the goods will be received by someone other than the Buyer, the Buyer must provide the details of the person who will receive the goods when filling out the delivery information for the order.
PRODUCT QUALITY GUARANTEE AND SUITABILITY PERIOD
9.1 The data of each product sold in the online store is generally indicated in the product description accompanying each product.
9.2 The Seller is not responsible for the fact that the goods in the online store may not match the actual size, shape, and color of the goods due to the characteristics of the Buyer's display.
9.3 In cases where, based on legal acts, a certain period of suitability for use is established for specific goods, the Seller undertakes to sell such goods to the Buyer in a way that provides them with a real opportunity to use such goods before the end of the suitability period.
9.4 In cases where the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts applies.
RETURN AND EXCHANGE OF GOODS
10.1 Quality goods are not returned or exchanged.
10.2 If necessary, the return and exchange of goods is carried out in accordance with the Rules for Return and Exchange of Goods approved by the Minister of Economy's Order No. 217 of June 29, 2001 "On Approval of Rules for Return and Exchange of Goods", the Civil Code of the Republic of Lithuania, and other applicable legal acts of the Republic of Lithuania.
RESPONSIBILITY
11.1 The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences arising from this and acquires the right to demand compensation from the Buyer for direct losses incurred.
11.2 The Buyer is responsible for actions performed while using the autokilimeliaionline.lt store.
11.3 The Seller is released from any liability in cases where losses arise due to the fact that the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, did not familiarize themselves with these Terms, although such an opportunity was provided to them.
11.4 If the Seller's online store contains links to websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information contained there or the activities carried out, does not supervise or control those websites, and does not represent those companies and individuals.
11.5 In the event of damage, the guilty Party compensates the other Party for direct losses.
11.6 The Seller is not responsible for the fact that the goods presented in the online store do not match the actual size, shape, and color of the goods due to the characteristics of the Buyer's display.
11.7 For violation of the purchase and sale agreement concluded using the online store, the parties are liable in accordance with the procedure established by the legal acts of the Republic of Lithuania.
MARKETING AND EXCHANGE OF INFORMATION
12.1 The Seller may, at its discretion, initiate various promotions in the online store.
12.2 The Seller has the right to unilaterally, without separate notice, change the conditions of promotions, as well as cancel them. Any change or cancellation of the terms and procedures of promotions is valid only going forward, i.e., from the moment of their implementation.
12.3 The Seller sends all notifications to the email address or phone number provided by the Buyer in the registration form.
12.4 The Buyer sends all notifications and questions and otherwise contacts using the phone numbers and email addresses indicated in the "Contacts" section of the Seller's online store.
12.5 The Seller is not responsible if the Buyer does not receive informational or confirmatory messages due to internet connection or email service provider network failures.
FINAL PROVISIONS
13.1 These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.
13.2 The law of the Republic of Lithuania applies to the relationships arising on the basis of these Terms.
13.3 In the event of damage, the guilty party compensates the other party for direct losses in accordance with the procedure and grounds established by the laws of the Republic of Lithuania.
13.4 All disagreements arising from the implementation of these Terms are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
